Terms of Service for Listkeep
1. Scope of Service
Listkeep provides automated research, item categorization, pricing recommendations, and listing creation services ("Services") based strictly on photographs, details, and information provided by the user ("Client"). Listkeep operates solely as a digital service provider and software tool.
2. Item Ownership and Storage
Listkeep does not take physical possession, custody, or control of any client inventory. The Client retains full ownership, possession, title, and responsibility for storing, securing, and maintaining all physical goods at all times.
3. Review and Accuracy of Listings
The Client acknowledges and agrees that all AI-generated or system-assisted titles, descriptions, pricing suggestions, and item specifics must be reviewed and approved by the Client prior to publication. The Client assumes ultimate responsibility for verifying the accuracy, condition notes, completeness, and legality of any listing published to any marketplace (including, but not limited to, eBay, Poshmark, or Mercari).
4. Fulfillment and Shipping
The Client is solely responsible for packaging, labeling, fulfilling, and shipping all sold items directly to buyers in accordance with applicable marketplace policies. Listkeep assumes no liability for shipping delays, damaged goods, lost packages, or buyer disputes.
5. Limitation of Liability
To the fullest extent permitted by law, Listkeep, its operators, and software suppliers shall not be liable for any direct, indirect, incidental, or consequential damages resulting from marketplace account suspensions, listing errors, pricing discrepancies, or unfulfilled buyer orders.
6. Service Fees
Service fees and retainer subscriptions are charged for research and listing generation work performed. Fees are non-refundable once listing drafts or services are delivered.
